1 Validity

Deliveries, services and offers of Blumen Elsdörfer via the online shop are made exclusively on the basis of the following terms and conditions.

All prices shown on the homepage are gross prices, the statutory value added tax is already included. Shipping costs are not included.

4 illustrations

The pictures shown are exemplary. As these products can be individual and handmade, the delivered product may differ slightly. However, the overall character remains.

If a flower is not available, we reserve the right to replace it with a commercially similar one. The monetary value is at least equivalent or higher.

5 Offer&contract

The presentation of the products is a non-binding catalogue, not a legally binding offer. By completing the purchase process, you will make a legally binding offer, which will be accepted by a confirmation email from Blumen Elsdörfer. This is the conclusion of the purchase agreement.

Section 6 Retention of title

The goods remain the property of Blumen Elsdörfer until the purchase price has been paid in full.

Section 7 Terms of Payment

The purchase price plus any shipping costs will be due with the order without deduction of discount. Payment shall not be deemed to have been made until the amount has been received by Blumen Elsdörfer. You have the possibility of payment by: credit card, Paypal, Bitcoin, upon collection. We reserve the right to exclude possibilities in individual cases.

Section 9 Terms of Delivery

  1. delivery takes place during business hours:

  2. Other times are only possible after consultation and surcharge.

  • The ordered goods we delivered from Blumen Elsdörfer on the agreed day. The buyer undertakes to accept the goods or to take care of the acceptance.

    In the event of non-compliance with these conditions, Blumen Elsdörfer is entitled to hand over the goods to a third party that we consider to be suitable or to deposit them in a place that we consider to be suitable.

  • The customer is liable for the completeness and correctness of the delivery data provided. In the event of errors, the customer shall bear the costs arising from second or third-party deliveries.
  • Blumen Elsdörfer is only liable in the event of gross negligence or intent.

    In special cases, such as Valentine's Day, Mother's Day and Christmas, orders can only be accepted up to 5 days before delivery date. Furthermore, Blumen Elsdörfer may to carry out the delivery one day before the desired date.

    Section 10 Liability&Warranty

    1. The Distance Selling Act expressly does not apply to our service, i.e. the trade in fast-perishable products, since our products are made specifically and only for the client.
    2. With the handover of the goods, the risk of accidental loss and accidental deterioration passes to the buyer. The handover is equivalent if the buyer is in default of acceptance is.
    3. If the delivered goods are defective, the buyer may, at his option, demand supplementary performance in the form of the rectification of the defect (repair) or the delivery of defect-free goods (replacement delivery). Blumen Elsdörfer may refuse the type of supplementary performance chosen by the buyer if it is only possible at disproportionate costs. In this case, the buyer's claim is limited to the other type of subsequent performance. The right of Blumen Elsdörfer to refuse these too, provided that it is only possible at disproportionate costs, remains unaffected. The contractual and non-contractual liability of Blumen Elsdörfer is limited to cases of intent and gross negligence.

    Blumen Elsdörfer reserves the right not to accept offers if, due to previous orders, there is a suspicion that the customer will not fulfil his contractual obligations. The same applies if the offer was made due to typographical or arithmetic errors by Blumen Elsdörfer.

    If individual paragraphs of these General Terms and Conditions are ineffective or lose their validity due to a later circumstance, the validity of the other paragraphs will remain unaffected.
